[MD] A dilemma for the MoQ

An extension of Michael’s inquiry into applied MoQ: 



Suppose there’s a breech of contract lawsuit brought before 3 judges.   In order for the plaintiff to prevail, it must be shown BOTH that the defendant violated the contract AND that the contract was valid. 
After both sides have presented their cases, the standing is: 



Judge 1 says the defendant violated the contract but the contract was invalid, so finds for the defendant. 
Judge 2 says the defendant didn’t violate the contract, though the contract was valid, so finds for the defendant. 



Judge 3 says the defendant violated the contract and the contract was valid, so finds for the plaintiff. 



When the judges deliberate, the consensus is that the defendant violated the contract and also that the contract was valid, so find for the plaintiff. 

Does the MoQ have any answer to this dilemma?
